§1. Definitions
The terms and expression used in the present statute mean:
1.1 Law Art Science – Law Art Science sp. z o.o. (private limited liability company incorporated under Polish law) established in Kraków, 35A/309 Kalwaryjska Street, 30-504 Kraków, registered in the Register of Entrepreneurs by the District Court for Kraków Śródmieście in Kraków, XI Economic Department of the National Court Register under KRS number 0000680861, NIP: 6751594948, REGON: 367416957, e-mail address : office@lawartscience.com, share capital: 5 000 zł (PLN);
1.2. Statute – the present statute available at www.lawartscience.com;
1.3. Website – website available at www.lawartscience.com;
1.4. User – every person (natural person, legal person, organizational unit not holding legal personality), using Website;
1.5. Newsletter – service of ordering and delivering information in the electronic form, in particular information concerning current events, employment offers, the newest blog articles available on Website and other information delivered on the User’s e-mail address.
§2. Initial provisions
2.1. Law Art Science provides services of Newsletter and Website’s content sharing to the Users, which are electronically supplied services in the meaning of the Act on Electronically Supplied Services of 18th July 2002 (consolidated text, Dz.U. from 2017, position 1219),
2.2. Law Art Science provides the services of Newsletter and Website’s content sharing to the Users pursuant to the rules set in the Statute.
2.3. Law Art Science sp. z o.o. (private limited liability company incorporated under Polish law) established in Kraków, Mogilska 65 St, e-mail address : office@lawartscience.com is the subject running the Website and the service provider within the meaning of the Act on Electronically Supplied Services of 18th July 2002 (consolidated text, Dz.U. from 2017, position 1219).
2.4. Current statute is available free of charge on the Website in a manner that allows Users to familiarize with the content of the Statue in every moment before making the contract of Newsletter service, and in a manner that allows the Users to obtain, open and save the content of the Statute.
§3. Rules within using of the Website
3.1. Using the Website and Newsletter is free of charge and voluntary.
3.2. Acceding to using the Website and Newsletter do imply acquaintance and acceptance of the Statute’s provisions, in particular provisions concerning personal data and an obligation to obey the rules implied by the Statute.
3.3. The User is in particular obliged to:
a) using the Website in a manner which shall not disturb its functioning, inter alia using the software and devices compatible with the Website.
b) using the Website pursuant to legal rules, the Statute and preservation of good customs, including the prohibition to deliver and submit the content restricted by legal acts, in particular submit false personal data within the service of Newsletter;
c) using the Website in a manner that may be burdensome for other Users;
d) using the content of the Website exclusively within the range of personal fair use and within the aim of concluding and performing the contracts on delivering electronically supplied services; exploitation of the content belonging to Law Art Science or third parties in any different manner is permittable only by an earlier and explicit consent of Law Art Science or the proprietor of the content.
3.4.Unless the provisions of this Statute provide for otherwise, works, trade marks, graphic elements, computer programs or their particular parts, data bases and other exclusive IP rights objects shared via Website are legally protected and belong to their proprietors – Law Art Science or other subjects with whom Law Art Science has concluded specific agreements. Every User using the Website is obliged to respect those rights.
§5. Cookie policy
5.1. While using the Website, User’s data is collected automatically by cookies, which are saved via Law Art Science server on the User’s device and which can be read by Law Art Science server while every connection from User’s device. Cookies are associated with User’s devise’s browser and User remains anonymous.
5.2. Cookies provide statistic data on Users’ movement and their using of specific subpages.
5.3. User in every moment can choose the way of cookies support by switching automatic cookies support to individual support. The detailed information on that matter is provided by internet support programs’ (browsers’) providers, usually in the tab “Internet options” or similar.
§6. Newsletter service
6.1. Every User has the possibility to use the Newsletter service free of charge. Newsletter service is run in Polish language.
6.2. Using Newsletter is possible after acceptance of the Statute’s provisions, in particular personal data provisions.
6.3. Newsletter’s user has the right to submit a complaint concerning inadequacies of Newsletter service with precise description of difficulties or problems arising, submitting User’s contact data within the aim to enable a contact with the User, in particular name, surname (firm), e-mail address on office@lawartscience.com.
§7. Personal data
7.1. Law Art Science performs the function of data controller within the meaning of the Act on Personal Data Protection of 19.08.1997 (consolidated text, Dz. U. from 2016, position 922) with respect to personal data within the meaning pursuant to the above mentioned act, submitted by the User and processed on the Website in connection with Newsletter service (in particular e-mail address).
7.2. Law Art Science will process the data submitted by the User pursuant to the Act on Personal Data Protection of 19.08.1997 (consolidated text, Dz. U. from 2016, position 922), the Act on Electronically Supplied Services of 18th July 2002 (consolidated text, Dz. U. from 2017, position 1219), and other Polish legal acts.
7.3. The User whose personal data is processed has the right to demand to cease processing his data, is able to be given an access to the data in every moment free of charge and has the possibility to correct and delate the data via contact with Law Art Science at office@lawartscience.com.
7.4. While providing electronically supplied services, the controller use the services of third parties, for example MailChimp, in order to conclude the process of ordering and submitting Newsletter and within this aim he conveys User’s personal data to the firm serving newsletters. The controller may confide User’s personal data processing to other parties providing services for the controller, in the necessary range to providing Newsletter service, on the ground of a written agreement.
§8. Liability
8.1. Law Art Science independently decide upon the Website’s functions, interface and infrastructure, in particular Law Art Science has the right to alter the Website’s content, interface and functions (as well as in the context of using particular functions of electronically supplied services) without an obligation to inform the User.
8.2. Law Art Science has the exclusive right to publish and to decide upon publishing the content of advertising character on the Website, not strictly related to services provided.
8.3. Law Art Science is not obliged to maintain the continuity or regularity in providing service of Newsletter and Website’s sharing. Law Art Science is authorized but not obliged to modify the functioning of the Newsletter service or to change Website’s content.
8.3. Law Art Science pays due diligence in order to ensure that all the content published on the Website is current and reliable information as well as to ensure proper functioning of the Website, fulfilling legal and ethical standards. Nonetheless the content published on the Website is not and cannot be claimed to be legal advice or be used as legal basis in dispute resolution. The content has the informational function only. In order to be provided with legal advice one shall contact Law Art Science via e-mail address office@lawartscience.com or other addresses given on the Website.
§9. Final provisions
9.1. Law Art Science has the right to alter the Statute after an earlier notice to the Newsletter’s users.
9.2. A current Statute is always uploaded on the Website.
9.3. The applicable law for the Statute is Polish law.
9.4. Any disputes shall be interpreted pursuant to polish legal system.
9.5. The Statute enters into force by 15.10.2017.
